California Levaquin Lawsuit Moved to Minnesota


A Levaquin lawsuit filed in California has been moved to Minnesota multidistrict litigation after the plaintiff's Levaquin lawyer requested the move. Arthur Dement filed his Levaquin lawsuit on July 25, 2011after experiencing side effects associated with the antibiotic. It was transferred to Minnesota multidistrict litigation on the 12th of January, 2012.

Dement's case is not unlike other Levaquin side effects cases, with the plaintiff filing suit against drug maker Johnson & Johnson after experiencing side effects such as Levaquin tendon rupture and Levaquin rotator cuff tears. Dement is seeking damages from Johnson & Johnson, including general, punitive, and special damages that total in excess of $75,000. 

The complaint filed by Dement's Levaquin lawyer alleges that Johnson & Johnson made "untrue and misleading statements" and misrepresented Levaquin as a safe and effective antibiotic. Levaquin is often used to treat bacterial infections and other infections often treated by general antibiotics.

The Food and Drug Administration was pressured by consumer advocacy group Public Citizen in 2008 regarding the link between Levaquin use and side effects such as tendon rupture, resulting in the Food and Drug Administration ordering Johnson & Johnson to place a black box warning on Levaquin packaging advising patients of the potential risk of serious side effects. 
Unfortunately, this warning came too late for some--a number of people had already experienced Levaquin side effects after being prescribed the antibiotics. These people are, for the most part, the patients eligible to file Levaquin lawsuits. Because of the FDA warning, patients may no longer be able to file Levaquin lawsuits, especially if the statue of limitations has expired.
